The Wavelino Platform, its look and feel, its design and organization, the
arrangement,
collection, and compilation of the foregoing (collectively, the "Platform
Content"),
and all intellectual property rights embodied in or arising from any of the
foregoing (including
without limitation, copyrights, trademark rights, patent rights, database rights,
moral rights,
sui generis rights, and other proprietary rights) (collectively, the "IP
Rights") are
and shall remain Wavelino's sole and exclusive
You are not granted ownership rights to any Platform Content or Intellectual Property
Rights by
using the Platform or any of its services.
In addition, Wavelino does not grant you any license to use any of the foregoing,
either
explicitly or implicitly, except where expressly permitted as follows:
- You are permitted to view, view, and use the Platform Content on your personal
computer or
any mobile or internet-enabled device for your personal, non-commercial use,
provided that
you do not erase, modify, or tamper with any of the proprietary notices that are
attached to
the Platform Content.
- You are prohibited from modifying, transmitting, participating in the transfer
or sale of,
creating derivative works based on, performing, displaying, copying,
reproducing,
publishing, or otherwise utilizing the Wavelino Platform, any Platform Content,
or any
Intellectual Property Rights, except as permitted above.
You are strictly prohibited from making any kind of commercial use, distribution,
publication, or
exploitation of the Wavelino Platform or the Platform Content by yourself. This
includes, but is
not limited to, framing or linking to this website or application or engaging in
commercial
transactions like reselling or redistributing images or other Platform Content that
is on the
Platform or accessible through its services.
In accordance with Wavelino's terms of service, you can only use the platform and
its content
in limited ways. You may be held liable for any unauthorized use of this
Platform or the
Content thereon, and you may also violate copyright law, other Indian laws, laws of
other
countries, international treaties, and applicable state laws. In the event of
unauthorised
use of the Platform or Platform Content, Wavelino may pursue legal action to recover
damages
against the defaulting and liable parties in addition to any other rights or
remedies.
Intellectual Property of Wavelino
- You agree not to challenge Wavelino's (or its licensors') ownership of
the content
on the Wavelino Platform, and you acknowledge and agree that Wavelino or its
third-party
licensors own all copyrights and other rights, title, and interests in and to
that content.
- You may not use any name, logo, trademark, or service mark available via the
Platform
without Wavelino's prior written approval, and neither this Policy nor our
Terms of
Service should be construed as granting any license or right to use any name,
logo,
trademark, or service mark displayed in the Platform without the written
permission of
Wavelino or such third party that may own the trademark displayed via the
Platform.
- You are not permitted to copy, display, distribute, perform, create derivative
works of, or
otherwise use the Platform or its content except as expressly permitted in this
Policy or
our Terms of Service.
Intellectual Property Violations
- You can notify us by sending an infringement/takedown notification if you
believe that your
protected work was posted on Wavelino's Platform or hosted by Wavelino in
another way
without your permission.
- Within 24 hours of receiving your notification, Wavelino will temporarily
suspend the
relevant content and review your infringement and takedown request with our
Grievance
Officer. The review process can take up to 15 days, and if the content is found
to violate
or infringe your rights, it will be removed from the site permanently 36 hours
after the
review is finished.
- You must submit a notice in accordance with our Infringement / Takedown Policy
in order to
request the removal of content based on an infringement or violation of your
rights.
- Please be aware that, according to applicable laws, intentionally submitting a
false or
misleading report may result in damages liability.
- Wavelino or a third party may make any information you provide in your
infringement or
takedown notification public. This information may also be sent to the content
uploader.
- Please be aware that when Wavelino is not a party to the dispute, it is not able
to decide
disputes between third parties.
- If we need more information or have any questions about your infringement or
takedown
notification that you have sent us, we may get in touch with you.
Indemnification
- In the event that Wavelino takes over the exclusive defense and control of any
matter that
would otherwise be subject to your indemnification, you agree to cooperate with
Wavelino in
asserting any available defenses at your own cost.
- To make things clear, you agree to defend, indemnify, and hold Wavelino harmless
from any
claims made by a third party that owns, controls, or claims any right to your
uploaded
content, including claims for use or re-use fees and royalties.
- Your use or misuse of the Platform, Service, Content, or otherwise from your
User Uploaded
Content, violation of our Terms of Service, infringement by you, or any third
party using
your account, of any intellectual property or other right of any person or
entity, and for
breach of any of your representations and warranties in this Policy or our Terms
of Service
are all grounds for you to defend, indemnify, and hold harmless Wavelino, its
affiliates,
authorized sublicensees, distributors, and each of their employees, contractors
Content Uploaded by Users
- All of your ownership rights remain intact when you upload content to Wavelino
(referred to
as "User uploaded content"). However, you grant Wavelino (and its
successors) a
royalty-free, perpetual, irrevocable, transferable, worldwide, non-exclusive
right to use,
license to reproduce, modify, adapt, publish, translate, create derivative works
from,
distribute, derive revenue or other remuneration from, communicate to the
public, perform,
and display the content (in whole or in part), and/or to incorporate it in other
works in
any form, media, or technology now known or later developed, for the full

- The following are your representations and warranties to Wavelino:
- Your uploaded content and its availability on the Platform do not and will not
infringe any
third-party rights, such as intellectual property rights, the rights of
performers, privacy
or publicity rights, or confidential information rights.
- You are the original creator of your uploaded content, and you have obtained all
necessary
rights, licenses, consents, and permissions to use it at any time during any
applicable use.
- Wavelino, its subsidiaries, affiliates, successors, and assigns, as well as
their employees,
agents, directors, officers, and/or shareholders, are not and will not be held
liable for
the content you upload.
- To include their name, voice, image, or likeness in your uploaded content and to
publish it
on the Platform and via any Linked Services, you have obtained all necessary
consents,
permissions, and/or releases from all individuals who appear in it.
- As permitted by the Platform and our Terms of Service, you also permit any
subscriber to
access, display, view, store, and reproduce such content for personal use.
