We at Wavelino want to make a platform that is safe and secure for our users, so we
don't let
content that is offensive or illegal or that violates the intellectual property
rights of
someone else on the Wavelino Platform. Users are prohibited from posting,
sharing, or
sending content that violates Wavelino's Terms of Service, such as content that
violates
India's security or sovereignty, disturbs public order, is defamatory, obscene,
pornographic, paedophilic, invasive of another person's privacy, or is harmful
to
minors. Users are prohibited from posting, sharing, or sending anything that
infringes on
the copyright, trademark, or other intellectual property of another. Please
check that your
notice is complete and that your statements are true before submitting any request.
Please
promptly provide any additional information that we may require to complete your
notice. Your
request may not be processed further if you do not provide the necessary
information.
Copyright
The owner's copyright safeguards original creative works of authorship, such as
songs,
videos, and images. However, a copyright can only safeguard the original expression
of ideas; it
cannot safeguard facts or underlying concepts.
- Copyright Violation
- Copyright-infringing content is not permitted by us. Each user is
responsible for
ensuring that the content they upload does not violate any copyright
held by third
parties. A violation can occur if copyrighted content is used without
permission or
for a legitimate reason. Keep in mind that, according to Section 52 of
the
Copyrights Act of 1957, some unauthorized uses of copyrighted materials
are not
infringements because they fall under the category of "fair
use."
- Content removal or account suspension
- If Wavelino is informed in a timely manner that the materials or posts
violate the
copyright of a third party, it will remove those materials or posts
temporarily and
respond to the request within 24 hours. The infringement/takedown
request that has
been submitted to us will be reviewed by our Grievance Officer. The
review process
can take up to 15 days, and if the content is found to violate or
infringe on the
rights of a third party, it must be removed permanently within 36 hours
of the
review's conclusion.
- Please be aware that multiple copyright violations in connection with
your use of
the Wavelino website or application or other violations of the Terms of
Service may
result in your account being permanently suspended or terminated.
- Notification of Copyright Violation
- You can file a copyright infringement notification if you believe that
your
copyright-protected work was posted on Wavelino's website or app or
hosted by
Wavelino in another way without permission. Please think about whether
the use could
be considered fair use before sending us a copyright notification.
- You must submit a notice that includes the following to make a copyright
infringement request to Wavelino for the removal of materials:
- A person authorized to act on behalf of the owner of an
exclusive right that
is allegedly being violated's physical or electronic
signature. An
"electronic signature" can be as simple as typing your
name at the
end of an email or letter sent electronically.)
- Your name, address, phone number, and email address. Please
specify your
relationship to the uploader if you are the uploader's
authorized
representative, such as an attorney.
- A thorough explanation of your problem. For instance: a
comprehensive
description of the act that you believe violates your legal
rights and
copyright; what objective do you want to achieve with this?

- A declaration that you are confident that the copyright owner,
its agent, or
the law do not permit the use of the work.
- A declaration that you are the owner of the copyright or
authorized to act
on behalf of the owner of the copyright, made under penalty of
perjury, and
that the information provided above is true.
- Send the following information to us via an email: info@wavelino.com
- Within 24 hours of receiving your notification, Wavelino will
temporarily suspend
the relevant content and review your infringement and takedown request
with our
Grievance Officer. The review process can take up to 15 days, and if the
content is
found to violate or infringe your rights, it will be removed from the
site
permanently 36 hours after the review is finished.
- Wavelino or a third party may make any information you provide in your
copyright
infringement notification public in any way, including by forwarding it
to the
content uploader.
- Please be aware that if you knowingly and materially misrepresent that a
post or
activity is infringing, you may be liable for any damages, including
costs and
attorneys' fees, incurred by us or our users. Before submitting a
notification
to us, you should consult an attorney if you are unsure whether the
material you are
reporting actually infringes.
- Counter-Notification for Copyright Violation
- You may send us a counter-notification if you believe that the post or
materials
reported in the copyright complaint were removed in error or
misidentified. A
counter-notification can have legal repercussions and is a request to
Wavelino to
reinstate the removed content.
- Within 24 hours, Wavelino will acknowledge your counter-notification,
and our
Grievance Officer will examine your counter-notification request.
- We will promptly send a copy to the original notice filer within 48
hours of
receiving a valid counter-notification. This indicates that Wavelino or
a third
party may make the counter-notification public and that the
complainant's
contact information will be shared with them.
- The complainant might file a lawsuit to get a court order to keep the
content down
during this time. The information provided in the counter-notification
may be used
by the complainant to sue you. Kindly note that we can't offer any
legitimate
counsel. Consult an attorney if you have any questions.
- We may replace or cease disabling access to the post or material that
was removed if
we do not receive notice within twenty business days of forwarding the
counter-notice that the complainant is seeking a court order to prevent
further
infringement. Please be aware that Wavelino has sole discretion over
whether content
will be reinstated or removed permanently.
- Please be aware that posting content that was removed as a result of a
copyright
infringement complaint could result in the permanent suspension of your
account.
Instead of re-posting the content, please submit a counter-notification
if you
believe it was removed in error.
Trademark
A trademark is a word, symbol, slogan, design, or combination of any of the
aforementioned that
distinguishes a product or service from those of others and identifies the owner as
the source.
Wavelino's trademark policy may be violated if you use someone else's
trademark in a way
that leads people to believe you are related to the trademark owner.

- Our Platform may remove user content that violates another person's
trademark.
For multiple trademark violations in connection with your use of the
Wavelino
website or application, as well as other violations of the Terms of
Service, your
account may be suspended or terminated.

Controversial Content
Content that violates any applicable laws or regulations, as well as content that
threatens
India's security or sovereignty, disturbs public order, is seditious, offensive,
defamatory,
obscene, indecent, pornographic, pedophilic, invasive of another person's
privacy, or
harmful to minors, are considered objectionable. Each user is responsible for
ensuring that the
materials or content they upload do not violate any laws or regulations.
- Wavelino Team
- In accordance with Article 19(2) of the Indian Constitution and
the
Information Technology Act and Rules, Wavelino is obligated to remove
any content
that it deems objectionable within 24 hours.
- Wavelino has a Chief Compliance Officer and a team of experts who review
and monitor
all content uploaded by users on the Wavelino platform.
- In accordance with the Information Technology Act and Rules, Wavelino is
required to
store and preserve a copy of the user information and data of the
individual
uploading the objectionable content for a minimum of 180 days. This
includes, but is
not limited to, the contact information, material history on the
Platform, and
technical records.
- Legal or Governmental Complaint
- Wavelino will have a Grievance Officer who will respond to any
notification from the
government or court order within 24 hours and will also appoint a Nodal
Officer who
will be available to assist law enforcement with any complaints.
- Wavelino is required to remove any objectionable content that has
been posted
on the Wavelino platform within 36 hours of receiving a notification
from the
government or a court order that prohibits it.
- Within 72 hours of receiving a takedown complaint, the Chief Compliance
Officer is
required to notify law enforcement of the matter and trace and identify
the source
of the objectionable content.
- User Takedown Concern
- If you think that content that is objectionable or illegal was posted on
the
Wavelino website or app, you can tell us about it by providing the
following
information:
- Your address, phone number, email address, and name.
- a comprehensive description of the content that is objectionable
or illegal,
including the URL or other identifying location of the content
that is
allegedly objectionable or illegal (please feel free to use
screen shots to
make it easier for us to locate such content).
- Your physical or digital signature. You can meet this
requirement by writing
your full legal name, not a company's name, at the bottom of
your
notification. Send the aforementioned data to info@wavelino.com
via email.
- Wavelino may notify the user who uploaded the objectionable content that
an
objectionable content complaint was received by us and that the
objectionable
content will be suspended while we review the complaint. Wavelino may
also notify
the user who uploaded the objectionable content.
- Within 24 hours of receiving a valid complaint, Wavelino will
temporarily suspend
the mentioned objectionable content and acknowledge the takedown
complaint. Our
Grievance Officer will then examine the mentioned content. The review
process can
take up to 15 days, and if the content is found to be in violation of
Indian law and
Article 19 (2), it will be removed from the site permanently within 24
hours of
completion.
- Getting rid of content; Account suspension or termination
- We reserve the right to remove from our Platform any user-uploaded
content that is
in violation of any applicable laws or regulations. Please be aware that
reposting
content removed as a result of a takedown complaint may result in the
permanent
suspension of your account. In addition, if you violate the Terms of
Service in any
way or repeatedly use the Wavelino website or application, your account
could be
permanently suspended or terminated.
